Andrew D. LocktonIP Litigation and Transactions Attorney
Andrew’s practice at McHale & Slavin focuses on IP litigation in federal trial and appellate courts, before the Patent Trial and Appeal Board, and advising in patent and trademark prosecution and appeals. His litigation experience includes asserting and defending claims in patent infringement, trademark infringement, unfair competition, copyright infringement, and anti-trust cases. He is also a member of McHale & Slavin’s appellate practice, working on cases before the Patent Trial and Appeal Board and United States Court of Appeals for the Federal Circuit. In an effort to give back to his community, Andrew works with the Legal Aid Society of Palm Beach County to provide pro bono representation when possible.
Before joining McHale & Slavin, Andrew gained invaluable insight into the federal court system as a Judicial Extern to the Honorable Otis D. Wright, II, U.S. District Judge in the Central District of California, where he was involved in the research for, and preparation of, orders and opinions for civil litigation, including: patent and copyright infringement actions; § 1983 civil rights claims; defamation claims; California anti-SLAPP claims; appellate review of claims from bankruptcy court; Truth in Lending Act and Real Estate Settlement Procedures Act claims; sanctions motions; attorneys’ fees motions under the exceptional case standard; and advising on the limitations of settlement communication protection under Fed. R. Civ. P. 408.
Andrew graduated law school in the top of his class and was awarded the CALI Excellence for the Future Award in patent law. While in law school Andrew served as a staff member of, and then the research and special projects editor for, the Southwestern Journal of International Law, where he published an article analyzing the limitations of the Lanham Act in the increasingly global business environment.
Away from the office, Andrew enjoys spending time running, cycling, and swimming, a throwback to his days as a professional triathlete, usually while reviewing the cases being currently argued before the U.S. Court of Appeals for the Federal Circuit and the U.S. Supreme Court. In keeping with his passion for the law, Andrew is currently working on articles addressing conflicts between the Patent Act and its implementation in practice.
